Regulators know this gap exists. Bridging it will require a fundamental rethinking of how AI liability is codified in law—a process that, by any realistic estimate, is years away from completion.
Building Governance Into The Foundation
Forward-thinking organizations are not waiting for regulators to catch up. The enterprises best positioned for this shift are those treating governance as a core design requirement—not a compliance checkbox bolted on after deployment. This demands concrete structural work across several dimensions.
First and most critically, organizations must establish clear decision boundaries: a formal taxonomy defining which decisions may be made solely by the AI, which require human review before execution, and which must always remain in human hands. These boundaries cannot exist only in a policy document—they must be technically enforced and continuously audited.
Second, every AI-driven decision must be documentable, traceable, and explainable—particularly in regulated industries. This is simultaneously a technology requirement, a legal requirement, and an operational imperative. Organizations that cannot reconstruct the reasoning behind an autonomous decision will find themselves exposed in regulatory audits, litigation, and the court of public opinion alike.
Third, governance cannot be siloed inside a single team. Effective agentic oversight demands active collaboration across technology, legal, risk, compliance, operations, and business leadership. Cross-functional alignment is not a nice-to-have—it is the mechanism by which efficiency gains and accountability obligations are held in balance.
